Terms of Service

1. Agreement to Terms

By accessing or using FitWeb services provided by Strickland Technology ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Services

FitWeb provides website design, development, and hosting services specifically for fitness professionals. Our services include:

• Custom website design and development using our template system
• Website hosting on our dedicated infrastructure
• Lead capture and management tools
• Domain connection and SSL certificates
• Ongoing maintenance and support based on your plan

3. Plans and Pricing

We offer multiple subscription plans (Free, Pro, Elite) with varying features and pricing. All prices are in USD. We reserve the right to modify pricing with 30 days' notice to active subscribers.

4. Payment Terms

Paid plans are billed monthly. Payment is processed via Stripe. You authorize us to charge your payment method on a recurring basis. Failed payments may result in service suspension after a 7-day grace period.

5. Cancellation

You may cancel your subscription at any time. Upon cancellation:

• Your site remains active through the end of the current billing period
• No refunds are issued for partial months
• You may export your content before your site goes offline
• Free plan sites remain active indefinitely

6. Your Content

You retain ownership of all content you provide (text, images, logos). You grant us a license to host and display this content as part of delivering our services. You are responsible for ensuring your content does not infringe on third-party rights.

7. Acceptable Use

You agree not to use our services to:

• Distribute malware or engage in phishing
• Send unsolicited communications (spam)
• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Host content unrelated to your fitness business

8. Uptime and Support

We target 99.9% uptime for hosted websites. Support response times vary by plan. We do not guarantee uninterrupted service and are not liable for downtime beyond reasonable efforts to restore service.

9. Limitation of Liability

FitWeb and Strickland Technology shall not be liable for indirect, incidental, or consequential damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Changes to Terms

We may update these terms with 30 days' notice. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
